Petition seeking FIR against Jaya for cheating

Chennai, Oct 30: A petition was today moved in the Madras High Court seeking a direction to police to register an FIR alleging that AIADMK General Secretary J Jayalalithaa received money along with applications from candidates to contest Lok Sabha and Assembly polls but did not return it when they were not allotted seats.

Mr Justice R Raghupathy, before whom the petition filed by N S Ziauddeen came up for hearing, adjourned it to next week after a request from Government Advocate Saravanan and permit him to take notice on behalf of Teynampet Inspector of Police.

Mr Ziauddeen said in February 2004 and 2006, Ms Jayalalithaa invited applications from AIADMK members who wished to contest Parliamentary and Assembly elections. He said he wanted to contest.

On February 2, 2004, he paid her Rs 15,000 along with an application form to contest from Vellore constituency. He also paid Rs 10,000 on February 4 last with an application to contest Thousand Lights seat.

When AIADMK members submitted application forms, she should have formed a committee, interviewed them to assess merit and decided on their candidature. Though he was induced to deposit a hefty amount with her on promise of a possible party ticket, he was not interviewed, nor were the other applicants, he said.

He alleged that Ms Jayalalithaa had already made up her mind to nominate contestants. But, she wanted to collect a huge amount from party members by making false promises, he said.

With fraudulent intention of inducing members to part with money, she distributed application forms and after getting money from thousands, announced names that she had already selected and did not refund money, he said, adding it was a clear case of cheating.

He submitted that he had already sent a letter to her August 4 this year along with relevant enclosures and it was received by her the next day.

She has not returned the money and is liable to punishment under Section 420 of the IPC, he said. He sent a report to the Inspector of Police, Teynampet on September 18 to register an FIR and investigate the case.

But police did not take any action, he added.
