SC order on creamy layer will destabilise quota concept: PMK
Chennai, Oct 20 (UNI) Pattali Makkal Katchi (PMK) Founder-Leader S Ramadoss today said the Supreme Court's order excluding ''creamy layer'' from benefits for SC/STs would destabilise the basic concept of reservation.
Taking strong exception to the Apex Court order stating the creamy layer among SC/STs will be excluded from the purview of quota in employment and promotion, Dr Ramadoss said this posed serious threat to the very basic principle of reservation and the order needed amendment.
Reservation was a policy issue and the judiciary should not intervene in it, he said adding it should be left to Parliament and state legislatures to frame the reservation policy and enact laws in this regard.
The judiciary could step in only if there were any discrepancies in the laws, he said. The judiciary should never try to dictate that the law on reservation should be only on certain lines.
This would disturb Constituional balance and democratic functions, he said.
Stating the judiciary was continuously intervening and 'posing threat to social justice,' Dr Ramadoss said the time had come to put an end to this and called upon all political parties and social welfare activists to take a firm decision on the issue.
