HC directs principal secretary to submit explanation

Allahabad, Oct 16 (UNI) A Division Bench of the Allahabad High Court has directed the principal secretary (Home) of the state to submit an explanation within two weeks for his omission that how he failed to mention the name of Ram Briksh Yadav, who has been provided with five security personnel.

The principal secretary on the court's direction had furnished the list of all the people of the state whom gunners were provided by the government but a Samajwadi Party leader's name was not mentioned in the list.

The bench comprising Justice Imtiaz Murtaza and Justice Amar Saran recently passed this order on a writ petition filed by Omkar Yadav-- a native of Sant Kabir Nagar district, seeking immediate arrest of Ram Briksh Yadav under section 147, 148, 149, 308, 302, 323, 504, 506 of the Indian Penal Code.

The petition said inspite of the High Court's order of March 24 this year, Mr Yadav did not surrender before the Chief Judicial Magistrate, Basti.

Commenting on the act of the CJM, the judges said, ''However inspite the clear and categorical order and observations of the division bench, CJM M P Singh Yadav appears to have proceeded in a very lackadaisical manner and violated the orders of the bench.'' The court has directed the Chief Judicial Magistrate to submit an explanation within two weeks the reasons for his decline to secure the attendance of Mr Yadav and failure to issue a non-bailable warrant inspite of orders of the High Court.

Mr Yadav is a leader of the ruling Samajwadi Party and is involved in the murder of Mahatam Yadav during the Gram Panchayat elections last year. The High Court has directed the magistrate to take cognizance against Mr yadav.
