HC notice to PUDA on discretionary plot
Chandigarh, Oct 13 (UNI) The Punjab and Haryana High Court today directed the Punjab Urban Development Authority (PUDA) to decide on the representation for allotment of a residential plot to the petitioner former Punjab minister Brij Bhupinder Singh within four months by passing a speaking order.
The direction was given by the court's division bench comprising Justice Viney Mittal and Justuce H S Bhalla.
The petitioner, Brij Bhupinder Singh, had submitted in his writ petition that on July 11, 1996 he had been allotted one kanal plot by the then Chief Minister Harcharan Singh Brar in urban estate, Mohali out of his discretionary quota.
Thereafter, chief administrator PUDA had also been asked to get the formalities completed in this respect. However, on the basis of a media report, the high court on July 17, 1996 stayed the allotments following which all the allotments made under the discretionary quota were cancelled.
However, the high court restored the plot to Olympian Harpreet Singh and Mrs .Vijay Kumari by giving them the benefit of the Supreme Court judgement in the case of Harsh Dhingra. It has been argued by the counsel for the petitioner Brij Bhupinder Singh that his case was also covered by the Supreme Court judgement as orders for allotment were issued before July 17, 1996.
