HC asks govt to ensure reservation for physically challenged

Patna, Oct 13 (UNI) Patna High Court today directed the Bihar government to ensure three per cent reservation for the physically challenged in government services and educational institutions.

During the hearing of a petition, a division bench of Justices Narain Roy and Seema Ali Khan directed the state government to issue directive to all departments concerned and Bihar Public Service Commssion (BPSC) to ensure three per cent reservation to the to the physically challanged in appointments under various categories.

The court also asked the state government to direct the education department for compliance of required reservation for disabled in all educational institutions.

Earlier, the petitioner had informed the court that the state government was not implementing the Protection of Disabled Equal Opportunity Act 1995, which makes the Centre and the state governments mandatory for making provisions of three per cent reservation for the physically challanged in government service and educational institutions.

Through an affidavit, BPSC had also informed the court that it had not received any directive from the government for reservation of the challanged.

The state government took the plea that all the departments had been directed in 2000 to follow the reservation guidelines. The court was not satisfied with the reply of the government and asked to file a report on December 4 about the compliance of the order issued for following the reservation for the disabled.

The court also directed the state government to inform about the welfare schemes prepared for the physically challanged.
