Court seeks inquiry report in DGP's case under sec 202 (1)

Indore, Oct 7 (UNI) A local court today ordered to produce inquiry report into the case, related to Director General (Home Guards) Swaraj Puri, under section 202 (1) of the CrPC, by November four.

Additional Sessions Judge Akhilesh Pandya gave more time for presenting the report in view of a revision petition filed by Mr Puri before the Madhya Pradesh High Court's Indore division bench.

Hearing a petition by Indore-resident Mahesh Garg accusing Mr Puri of securing admission for his son in an engineering college in Indore under NRI quota by presenting fake documents, the lower court had on September 15 ordered an inquiry into the case under section 156 (3) by the Economic Offence Wing of the Madhya Pradesh Police and sought report within a month after beginning hearing under section 202 (1).

The petition stated that Mr Puri showed Mr Babulal Somani as his father for admitting his son Shreyas Puri's. However, the name of Mr Puri's father was Mr Vidyasagar.

During the hearing of the revision petition before Justice S S Dwivedi, Mr Puri's counsel Vivek Tankha contended that after beginning hearing of the case under section 202 (1), the case could not be switched over to section 156 (3).

According to legal experts, registering of a case was mandatory when inquiry was ordered under section 156 (3). However, this was not the case when inquiry was ordered into section 202 (1).

Mr Vivek Tankha described the lower court's order as a legal blunder and not a legal mistake, as it ended Mr Puri's career, who was removed from DGP's post.

He pointed out that the then Director General (EOW) A R Pawar, who registered the case against Mr Puri, replaced him.
