Ensure Goregaon court becomes functional by Jan 15, HC tells State

Mumbai, Sep 27 (UNI) The Bombay High Court today directed the State Government to provide complete infrastructure and ensure that the additional sessions court at Goregaon becomes functional by January 15.

A division bench comprising Justices R M Lodha and S A Bobde were hearing a litigation filed by Adv M P Vashi and Mr Bhagwanji Raiyani alleging that the court-house at Goregaon, which was in the possession of the State Government, was not being utilised.

The building houses twelve court-rooms which are to be utilised for housing the city civil sessions court.

However, the Bar Council of Maharashtra contended that having the civil court at Goregaon will be very inconvenient for the lawyers who have cases lined up at Goregaon and Churchgate courts at the same time.

But Justice Lodha intervened saying that having courts in different parts of the city was a geographical necessity. He cited the example of the High Court that had benches at Aurangabad and Nagpur as well.

Another reason for the need to make the Goregaon court functional was that the civil court in South Mumbai would become insufficient as ten court-rooms of the High Court would be shifting there, said Justice Lodha.

The court further directed the Principal Secretary of State and Registrar, Legal, to submit compliance reports of the same on January 17. The case will come up for further hearing on January 18.
