Gajurel's petitions referred to CJ for fresh posting

Chennai, Sep 25 (UNI) A Division Bench of Madras High Court today referrred to Chief Justice to post before some other Bench, hearing on the Habeas Corpus Petition and a Writ Petition, pertaining to Nepalese Maoist Leader Chandra Prakash Gajurel.

The writ petition, seeking a direction not to deport Gajurel was earlier filed and was pending. The Habeas Corpus Petition (HCP) was filed by an advocate Senkodi, seeking to produce Gajurel in the court and set him at liberty was filed recently.

When the HCP came up for hearing before a Division Bench comprising Mr Justice P Sathasivam and Mr Justice S Tamilvanan last week, the Bench had directed the Registry to post the HCP along with the writ petition for hearing.

Accordingly, both the petitions came up for hearing today.

When the matter was taken up, the Bench said Gajurel has sent a letter to the Registry raising apprehension on the ground that his earlier petition, challenging his detention under the National Security Act was dismissed by a Bench headed by Mr Justice P Sathasivam. Hence he has requested the Registry not to post these two petitions before this Bench.

Hence, this Bench directs the Registry to place the matter before Chief Justice for posting it before some other Bench, Mr Justice P Sathasivam and Mr Justice S Tamilvanan added.
