Delhi Cabinet approves amendment to Cooperative Societies Act

New Delhi, Sep 25 (UNI) Delhi cabinet today decided to fully protect interests of flat owners in the national capital, holding General Power of Attorney (GPA).

In a meeting, chaired by Delhi Chief Minister Sheila Dikshit, it was decided to bring in an amendment in Section 91 of the Delhi Cooperative Societies Act which envisaged that a person who had bought a plot/flat in a society on Power of Attorney, may apply for membership and shall be granted membership by the Committee within 30 days after submitting application.

The person who had sold plot on GPA shall seize to be member of society from the date of sale. Ms Dikshit added that this amendment had been incorporated on the request of GPA holders who were facing difficulties in exercising their right as members of the societies.

It had also been decided to amend Section 75 to allow Cooperative Housing Societies to admit members exceeding the number of plots if the plot owner had constructed and sold floors. An amendment in Section 35 would empower the cooperative Societies to conduct the elections themselves except in certain cases where a dispute exists in the society, 1/6th members of the society requests the government to appoint a Returning Officer and in case of Cooperative Bank, Financial Bank, Federal Cooperative Society and such a housing society which had not been allotted land or which had been allotted land but draw of lots had not been conducted.

Apart from this amendment in Section 77 would provide for constitution of a committee under Secretary (Cooperation) with Registrar (Cooperative Societies) and other senior officers as members to clear the list of cases of societies for draw of lots for plots/dwelling units.

Ms Dikshit further said the Bill aimed at implementing the Right to Information more effectively in the cooperative societies, hence an amendment in Section 139 would empower a member to seek information/certified copies of documents from the management of the society.
