Rules apply to majority and minority institutions equally: HC

Allahabad, Sep 21 (UNI) The Allahabad High Court has ruled that the laws of land, including rules and regulations, must apply equally to the majority as well as minority institutions.

The minority institutions must be allowed to do what non-minority institutions are permitted.

Quoting an apex court judgement in the case of T M A Pai, the HC said the essence of Article 30(1) of the Constitution is to ensure equal treatment between the majority and minority institutions.

Allowing a writ petition of Hena Farheen, Justice S N Srivastava said the argument on behalf of the respondent college that it is competent to take a policy decision, independent of rules being followed by other colleges governed by the intermediate education board, merely on the ground it is a recognised minority institution cannot be sustained.

Thus, the court held that policy decision of the college that unless a student has taken math as a subject in high school, the student is not entitled to claim admission to the science stream is highly arbitrary being one not having genesis in restriction imposed by the intermediate education act or any regulation framed by the board.

Hena moved HC against the order of the principal St Anthony Girls Inter College, Allahabad where she was denied admission in class XI with bio group ie Physics, Chemistry and Biology, as she had not passed high school with maths as a subject.
