Reservation in teachers recruitment: Notice to Haryana

Chandigarh, Sep 18 (UNI) The Punjab and Haryana High Court today issued notices to the Haryana government, its education department and the State Staff Selection Commission on a writ petition seeking directions to quash the reservation for candidates from rural areas in the proposed recruitment of teachers.

The petition was filed by Mohinder Kumar and others from the state of Haryana.

The orders by the division bench of Justices M M Kumar and M M S Bedi were given on the amended petition filed by the petitioner after the counsel for the state government had asserted that the advertisement sought to be challenged by them was within the prescribed rules and that it needed to be dismissed as rules had not been challenged. In view of this, the petitioners had withdrawn their plea with permission to file an amended petition which was done.

The petitioners have pointed out that the reservation of fifty per cent posts for the candidates belonging to rural areas is against the Constitution as also the Apex Court decisions which had upheld that domicile could not form the basis for reservation. Also, the petitioners have objected to 33 percent reservation to women candidates in addition to the reservation to the scheduled castes, backward classes and the ex-servicemen.
