HC asks state govt to file counter affidavit
Allahabad, Sep 13 (UNI) The Allahabad High Court asked the state authorities to file counter affidavit within four weeks on a PIL seeking directions to the State government to constitute Nyay Panchayat.
The bench comprising Chief Justice A N Ray and Justice Ashok Bhushan passed the order on a writ petition filed by Ramesh Chandra Patel of Chitrakoot.
The petition said that sections 42, 43 and 44 of the UP Panchayat Raj Act provides for the constitution of nyay panchayats in the state.
''The elections of Gram Panchayats were held in August 2005 and Gram Panchayats wre constituted but till date no Nyay Panchayat was constituted, though it is the duty of the state government to constitute them,'' the petition alleged, It was further alleged that due to non-constitution of Nyay Panchayats, even the disputes arisen among the villagers are being filed in regular courts putting an additional burden on courts.
