HC directs CBCID to probe advocate's complaint

Chennai, Sep 8 (UNI) Madras High Court today directed the CBCID to take up investigation on a complaint by an advcate alleging foulplay in the death of his brother, who was also an advocate.

A Division Bench comprising Mr Justice D Murugesan and Mr Justice V Ramasubramanian gave the directive while disposing of a petition filed by Advocate K R Suryakumar, who alleged foulplay in the death of his brother K R Mohankumar.

The Bench directed the Assistant Commissioner of Police (AC), CCB, Egmore to hand over all the documents, including the case diaries and other records to the Superintendent of Police (SP), CBCID within a week.

The SP has to file a final report report within three months, the bench said and added that the trial before the lower court shall not proceed further.

According to the petitioner, his brother Mohan Kumar was killed in a road accident on December 7, 2003. Though the incident was projected as a road accident, he suspected that it was case of cold blooded murder.

His brother had taken life insuracne policies in various companies for huge sums, he said and contended that some insurance agents and their friends devised a plan to create bogus life insurance policies and made good with huge amount by way of claims.

The basis for his suspicion was that petitioner's mother received a cheque for Rs 20,000 on November 20, 2004 from the ICICI Prudential Life Insurance company towards first instalment, eventhough no claim was made by anyone. The very next day of the death, even before the body was handed over to the family after post-mortum, the insurance agent obtained the thumb impression of petitioner's mother in a blank paper.

The petitioner pointed needle of suspicion against certain individuals.

In his status report filed by the AC, it was stated that the suspicion of the petitioner was bonafide, but investigation cannot be proceed with unless the petitioner substantiate his claim.
