Delhi traders withdraw petition against sealing drive

New Delhi, Sep 8 (UNI) The Federation of Delhi Traders Association today withdrew their petition seeking a stay against the ongoing sealing of commercial premises illegally operating in residential areas in the national capital in violation of the Master Plan.

A bench comprising Chief Justice Y K Sabharwal and Justice C K Thakker directed petitioners' counsel Fali S Nariman to file an intervention application in the main case, which is already pending with the apex court.

In the main case, Residents Welfare Associations Federation challenged Delhi Laws (special provisions) Act 2006 putting a one-year moratorium on the sealing and removal of unauthorised constructions in the city.

The court again made it clear that prima facie the act seems to be invalid and void. Regarding the petition of Delhi traders, the court said it would consider their intervention application on merits as and when it was filed.

Regarding the notification issued by Union Urban Development Ministry yesterday, permitting mixed land used in several colonies to provide relief to traders facing closure of their shops under the ongoing sealing drive, the court said it would consider on merits as and when the matter was brought to its notice.

The main case is fixed for hearing in Supreme Court on September 12.
