HC maintains capital punishment in rape-murder case

Allahabad, Sep 1 (UNI) Allahabad High Court has upheld the death sentence awarded by a locl court to an accused charged with rape and murder of a minor girl.

The accused was charged under Indian Penal Code sections 364, 376 and 302.

The judgement was pronounced on August 29 by the HC bench comprising Justices Mahesh Chand Jain and K K Mishra.

The sentences passed by the Agra additional sessions judge in 2004 awarding 10 years' rigorous imprisonment and fine of Rs 10,000 under IPC section 364, life imprisonment and fine of Rs 15,000 under section 376 and death sentence under section 302 were upheld by the HC.

Accused Bantu of village Basai Khurd in Tajganj of Agra district, had enticed the five-year old girl on pretext of giving her a balloon.

Later, she was found profusely bleeding and rushed to S N Medical College, Agra where doctors pronounced her dead.

Bantu admitted to have raped and killed her.

Special judge/additional sessions judge Agra awarded Rigorous Imprisonment, life imprisonment and death penalty for the offences of abduction, rape and murder of the minor girl respectively, which were affirmed by the HC in toto.
