HC raps NDMC for unauthorised Gurudwara in diplomatic area

New Delhi, Aug 25 (UNI) The Delhi High Court today took strong objection to the statement by the New Delhi Municipal Council(NDMC) that it did not know anything about the unauthorised Gurudwara at Malcha Marg in the diplomatic area of Chanakyapuri in Central Delhi.

A division bench of acting Chief Justice Vijender Jain and Justice Rekha Sharma said how could the NDMC abdicate its responsibility on the unauthorised Gurudwara by filing a vague affidavit.

When Counsel Anjana Gusai appearing for the NDMC said that the authorities had written a letter to the Land and Development Office (L&DO) of the Urban Development Ministry, the Court said, ''It is the responsibilily of the NDMC to maintain the land in its area as the L&DO does not have the supervision machinery.'' While shifting the responsibility, Ms Gusai said that the gurudwara was constructed on the L&DO land and the Council could not do anything.

The Court asked the Chairman of the NDMC to file a comprehensive affidavit by September 29, the next date of hearing.

Counsel Pushkar Sood appearing as amicus curie said that there were illegal constructions on footpath and some more shops adjacent to the school building in the area.
