Child charged with molestation gets relief
Patna, Aug 11 (UNI) A local court today discharged six-year-old Raj Kumar a co-accused in a case of outraging the modesty of a woman when he was hardly two years old.
Judicial magistrate Sahab Kausar ordered discharge of the boy who had to appear in the court on different dates in connection with the case during the last three years.
One Renu Devi had filed a case alleging that her modesty was outraged by Raj Kumar, in league with his father Kedar Prasad, mother Kanti Devi and relatives Hira Prasad and Sushila Devi. The complainant and the accused are residents of Kumhar Tola in Kankarbagh locality of Patna.
All the accused were booked under various sections of the Indian Penal Code relating to assault or criminal force on a woman with the intention to outrage her modesty, deliberate insult with intent to provoke breach of trust, besides other charges.
Ms Renu Devi had mentioned in the FIR that Raj Kumar and his elder brother had outraged her modesty while his father claimed in an affidavit filed in the court that Rajkumar was his only son. The court had ordered the local ward councillor to report about the veracity of the fact and ascertain whether Mr Kedar Prasad had only one son.
But the councillor failed to submit the report till today and was asked to expedite the fact-finding process. The court deferred the framing of charges against four of the five accused barring the minor boy.
The court ruled that the fifth accused was a minor so it would not proceed against him for framing charge.
