Hearing on draft charges against Salem on Aug 17

Mumbai, Aug 9: The prosecution today submitted draft charges against extradited gangster Abu Salem and others before the TADA court in connection with the murder of builder Pradeep Jain during 1995.

Special Public Prosecutor Ujwal Nikam, in his submission before the special terrorist and Disruptive Activities (Prevention) Act Court P V Bavkar said that in the murder of builder Pradeep Jain, the accused persons had struck terror in the builder community. The conspiracy was hatched at Dubai and Mumbai and thus the accused in this case have committed an offence punishable under section 120 (B) of Indian Penal Code.

The next hearing of the case has been adjourned to August 17 as sought by the defence counsel.

Of the five accused in this case, Riyaz Ahmed Siddique and Mohd Naeem Khan filed application seeking pardon and turned approver in this case. Other three accused are Abu Salem, Mohd Hasan Mehendi Hasan and a builder Virendrakumar Bidarilal Jhamd.

On July 28, the crime branch had filed a chargesheet against Salem and others, bearing charges under sections 384 (extortion), 302 (murder), 307 (attempt to murder), 452 (house trespass after preparation for hurt, assault or wrongful restraint), 506 (ii) (criminal intimidation), 120 (B) (criminal conspiracy) of the Indian Penal Code, section 5 and 27 of the Arms Act and sections 3(2),(3), (5) and 5 of TADA Act for possessing and transporting weapons.

Pradeep Jain, a builder was gunned down March 7, 1995 in his office situated at Juhu area of the city as he failed to pay the exatortion amount. This is one of the two cases probed by the Crime Branch on the basis of which Salem was extradited from Portugal. The other one is the Ajit Diwani murder case.
