Kerala HC notice to Govt. on Self-Financing Colleges Act
Kochi, Jul 12 (UNI) The Kerala High Court today issued notice to the state government and the entrance examination commissioner on a batch of writ petitions challenging the constitutional validity of the Kerala Self-Financing Colleges (Regulation and Control) Act 2006.
Justice S Sirijagan also reserved interim order on the plea to stay the operation of the Act pending consideration of the writ petition.
The court will consider the impleadment petitions filed by various organisations later.
In the main argument addressed for self-financing college managements, counsel Vivek Thanka submitted that the Act is an ''adventerous legislation'' and it infringes the right of managements to admit students of their choice and to charge fees as permitted by the Supreme Court.
On the other hand Supreme Court Advocate C S Vaidyanathan on behalf of the state government submitted that in view of the 93rd Constitutional amendment, this type of legislation is permissible.
