SC issues notice to upon former cop's plea
New Delhi, July 2 (UNI) The Supreme Court has issued notices to the Uttar Pradesh government on a petition filed by a former UP police Inspector seeking to quash the high court order ordering his prosecution along with two other police officers for filing false affidavit in the Allahabad High Court.
Petitioner Ved Singh, who was posted as SHO, P S Sadar Bazar, Saharanpur, was arrested on the complaint of one Harish Arora from whom SI Dharampal Singh and Chauhan had demanded Rs. 2 lakhs as bribe in the presence of the accused SHO.
According to the petitioner, Arora was involved in several criminal cases in the area.
A bench comprising Justice A R Lakshmanan and Justice Altamas Kabir issued notice on June 29 after hearing the counsel for the petitioner who contended that the affidavit was not filed by his client. According to the petitioner, his petition under section 482 Cr. P.C. for quashing of the criminal proceedings against him was dismissed by the high court and the second petition under section 482 Cr. P.C. was filed by another accused Dharampal Singh who was an SI.
The high court directed the trial court to initiate proceedings for perjury against the accused petitioner who surrendered as per High Court order and is in jail since April, 2006.
The petitioner, who is also seeking his release on bail, has contended that in view of High Court order, trial court had dismissed his bail application.
The bribe was allegedly demanded for showing favour to the complainant Harish Arora in a criminal case.
