Lodha and other accused need to personally appear

Kolkata, Jun 29 (UNI) Chief Judicial Magistrate of Alipore Court Ashok Kumar Pal today passed an order on applications of R S Lodha, S N Prasad, V Gaurishanker and S K Daga, all four "accused of criminal conspiracy in respect of the trust", created by late M P Birla and Priyamvada Birla donating their entire property to charity.

All the four persons had filed applications for exemption from personal appearance in the court.

While allowing the said applications, Mr Pal had imposed several conditions laying down that the accused would have to appear before the court on the days fixed for filing of charge, for their examination under section 313 of the Criminal Procedure Code, when the judgement in the matter is delivered and as and when they will be directed by the court.

Under Section 313 of Criminal Procedure Code, the court has the power to examine the accused to personally explain any circumstance appearing in the evidence against him.

Hearing of another application filed by the complainant for search warrant against all the four accused is fixed on July 15, 2006.
