Court asks Lodha to be present during filing of chargesheet

Kolkata, June 29 (UNI) A local court today allowed the application of R S Lodha and three others accused of criminal conspiracy in respect of the trust created by the late M P Birla and Priyamvada Birla, praying for exemption from personal appearance during hearings.

Besides R S Lodha, S N Prasad, V Gaurishanker and S K Daga, had filed applications in the case relating to the trust created by the Birlas donating their entire property to charity.

Chief Judicial Magistrate of Alipore Court Ashok Kumar Pal while allowing the applications, ordered that the accused would have to appear before the court on the days fixed for filing of chargesheet, for their examination under section 313 of the Code of Criminal Procedure, when the judgement in the matter is delivered and as and when they will be directed by the court.

Under Section 313, the court has the power to examine the accused to personally explain any circumstance appearing in the evidence against him.

Hearing of another application filed by the complainant for search warrant against all the four accused is fixed on July 15, 2006.
