New Delhi, June 28 (UNI) Jet Airways today moved the Supreme Court seeking transfer of arbitration petition pending in the court of District Judge Lucknow to Bombay High Court on the grounds that Lucknow court has no jurisdiction to adjudicate the matter.

Jet Airways have also contended that a similar petition is already pending in Bombay High Court and it will be in the interest of justice if the petition pending in Lucknow court filed by Sahara Airlines is also transferred to Bombay High Court as it would eliminate the possibility of multiplicity of litigation.

Earlier Sahara India Commercial Corporation Ltd has filed a caveat in the Supreme Court praying that in the transfer petition, likely to be filed by Jet Airways (India) Ltd, no relief should be granted to the opposite party without hearing the caveator.

The caveat was filed by advocate E C Agrawala on behalf of Air Sahara yesterday against transfer of arbitration petition pending before the district judge, Lucknow, filed by Jet Airways.

The caveat has been filed in view of the press statements emanating from Jet Airways sources saying that Jet shall approach the apex court for transfer of the arbitration petition and also the case pending in Bombay High Court.

The present litigation is the outcome of rescinding the Rs 2300 crore deal between Sahara Airlines and Jet Airways vide which Sahara Airlines were to be taken over by Jet Airways.

Sahara India has threatened to file a suit seeking damages to the tune of Rs 2000 crore from Jet Airways for illegally backing out from the deal.
