EC to move division bench of High Court; A V S Reddy

Hyderabad, June 20 (UNI) Andhra Pradesh Election Commission (EC) will appeal to a division bench of the High Court seeking to set aside a single Judge's order quashing the EC notification for holding the Panchayat Raj polls in two phases on June 28 and July two.

Stating that as of now, there was no change in the election process, State Election Commissioner A V S Reddy told reporters here this evening, ''We will put forth before the bench the situation arising out of the single Judge's order.'' The Supreme Court had made it clear in the past that under Article 243 of the Constitution, only the Election Tribunal was the appropriate forum to handle such matters, he said, adding, if needed, the EC would also move the apex court.

Referring to flaws in the electoral rolls, Mr Reddy said 'there cannot be 100 per cent correct electoral rolls as additions/deletions will be there at any given point of time in a state with more than 3.90 crore voters. ''Thousands of people migrate to other places and no correction is possible after the date of notification,'' he added.

The EC was bound to hold the polls with the rolls prepared by the Election Commission of India for the Assembly polls and it had its limitations, he said.
