SC orders nursing home to vacate Suresh Oberoi's house

New Delhi, June 19 (UNI) The Supreme Court today granted nine months to a nursing home owner for vacating the Hyderabad house belonging to Bollywood actor Suresh Mohan Oberoi, father of filmstar Viveik Oberoi.

While dismissing the plea of Kishore Tagarsse, who is running the nursing home for the last 50 years, a vacation bench comprising Justices A R Lakshamanan and Altamas Kabir granted nine months to him to vacate the premises on the condition that he shall have to pay a monthly rent of Rs 5,000 and also pay the damages awarded by the Andhra Pradesh high court if the same have not been paid till now.

The court rejected the plea of the appellant for grant of two-year time to vacate the premises as the hospital is being run there for the last 50 years.

The appellant has challenged the High Court order on the grounds that it has overlooked the latest amendment in Rent Control Act. At present, the petitioner is paying Rs 1,400 as monthly rent for the premises. The Initial rent was Rs 500 per month.

The appeal was made against the eviction order passed by Additional Rent Controller subsequently upheld by the High Court.

The petitioner has also been directed to file an undertaking within three weeks to the effect that he will hand over peaceful and vacant possession of the premises on the expiry of nine months.
