Notices issued to K'taka Govt on KMIO Director's appointment

Bangalore, June 19 (UNI) The Karnataka High Court today ordered issuance of notices to the State Government and Selection Committee Chairman of Kidwai Memorial Institute of Oncology on a writ petition, challenging the legality and validity of the amended Cadre and Recruitment regulations of the Institute and the consideration of Dr B P Bapsy to the post of Director of the Institute.

Mr Justice Anand Byra Reddy issued the notices on the petition filed by Dr Ashok M Shenoy, Professor and Chairman of the Department of Head and Neck Surgery of the Institute.

The petitioner contended that the Regulations, which were in accordance with the requirements of the Medical Council of India Rules, had been amended on May nine, 2006, so as to suit the qualifications of Dr Bapsy and eliminate any other rival from being selected for the post.

The petitioner submitted that without issuing the required notification and advertisement inviting applications for appointment to the said post, the claim of Dr Bapsy, working as in-charge Director, had been considered and selected for the post. The respondent had been subjected to disciplinary proceedings on certain charges and was also facing several allegations as in-charge Director.

The amendment as well as the selection to the post was illegal and unconstitutional, the petitioner contended, seeking to strike it down and a direction to consider afresh his claim for the post.
