HC disposes petition filed by Shabnam Kapoor

Mumbai, June 19 (UNI) Bombay High Court today disposed of a petition filed by film producer Shabnam Kapoor seeking court direction to set aside criminal proceeding against her in a lower court at Bandra in suburban Mumbai.

Justice D B Bhonsale disposed of the petition as court liberty was sought to appeal to a lower court in the matter.

On October 24 last year, the ninth Court at Bandra had initiated proceeding against Kapoor under section 420 on a private complaint filed by producer Bobby Anand alleging that her film company, Amit Arts, had entered into an agreement with him for the overseas rights of the Hindi films 'Purab ki Laila Paschim ka Chaila', 'Radhe Shyam Sita Ram' and 'Nihattah'. Anand had also paid her advance amount running into lakhs of rupees but Kapoor had not fulfilled her promise and duped him.

Following the private complaint by Anand, the Bandra Court had issued a process against Kapoor directing her to face the trial.

Kapoor challenged the lower court order by moving the High Court and denying the allegations made against her. She contended that due to her illness the film could not be completed. She also submitted that the offence was civil in nature hence the proceeding filed in the lower court was an abuse of the lower court's process and also done with vindictive attitude to cause harassment, inconvenience and damage to her reputation.
