New Delhi, June 19 (UNI) The BJP today said the Congress had no right to seek a probe into the Central Vigilance Commission (CVC) report on Housing and Urban Development Corporation (HUDCO) ''scam'' and added it would not like to comment as the matter in subjudice.

BJP Spokesman Prakash Javadekar, on being asked the Congress demand for a probe on the role of former Urban Development Minister Ananth Kumar and his staff utilising HUDCO facilities beyond their entitlement, said Mr Kumar will submit his reply to the Supreme Court where the matter is pending.

BJP sources however said the charges were nothing new because the Congress had used the allegations against Mr Kumar in the last parliamentary polls and using the HUDCO privilege by a minister and his staff was nothing new.

''It is not an embezzlement. If somebody has used furniture and other such resources of the HUDCO, the assets will revert to the institution once he ceases to be a minister,'' sources said.

Earlier in the day, the Congress demanded a thorough probe into the role of Mr Kumar in the light of his indictment by the Central Vigilance Commission (CVC) in the Housing and Urban Development Corporation (HUDCO) ''scam'' that had taken place during the NDA regime.
