File affidavit regarding illegal structures: HC to KDMC commissioner

Mumbai, June 15 (UNI) The Bombay High Court today directed the Commissioner of Kalyan Dombivili Municipal Corporation to file an affidavit regarding the illegal structures constructed in his jurisdiction by July 6.

A division bench comprising Justices R M Lodha and A S Bagga directed KDMC to file an affidavit regarding illegal structure with details like plot numbers, names of the occupants, whether the occupants are commercial or residential or both, and present status of the court proceeding regarding the illegal structures in various courts, and the action taken to demolish the same till May 31 this year.

The court gave the directions on the basis of a public interest litigation filed by Mr Kautubh Gokhle regarding illegal structures in Kalyan.

KDMC counsel told the court that the KDMC had identified 27,533 illegal structures out of a total of 11 lakhs structures, in its affidavit filed on May 29 last year. About 1,730 cases regarding some of the illegal structures were pending various local courts.

Also, notices had been issued to various occupants.

The court was also told that there were many such illegal structures that were being constructed and no action had been taken in the matter by the KDMC.

However, as the KDMC counsel was unable to provide specific details of the action taken on the demolition of these structures, the court passed the said directions.
