Pravin Mahajan's application to be heard tommorrow

Mumbai, May 30: A city court today adjourned till tommorrow fresh application of Pravin Mahajan, the accused of murdering his elder brother senior BJP leader Pramod Mahajan, seeking direction to institute a judicial inquiry in his mental and emotional status in the days prior to the incident.

The application was moved by Pravin's counsel S R Yadav and S Verma before additional Chief Metropolitan Magistrate A Waghmare who adjourned the hearing as defence and prosecution lawyers sought time and said since tomorrow is the next date of judicial remand of Pravin and hence the plea be heard on the same day.

In his plea, court was told that prosecution is yet to find out the motive behind the incident and therefore it is neccessary to refer the case of accused before the medical board to enable him to undergo psychiatric test.

According to the application, police is only gathering the evidence which will benefit the prosecution but not collecting evidence which will benefit the defence and hence it was violating the apex court order which says that it is the duty of the investigating officer to not only collect such evidence which bolsters the prosecution and conviction but also which favours defence as well.

Meanwhile, the Court will also hear Pravin's earlier application to provide him psychiatric treatment before police conducts any investigation against him.

The Court on earlier three occasions, turned down the same plea after Mumbai police contended that Pravin does not require any psychiatric treatment as the doctors who had conducted the medical check up, found him to be normal and did not suggest any further treatment.
