Tamil Nadu files civil suit against Kerala
New Delhi, Apr 18 (UNI) The state of Tamil Nadu today filed a civil suit against the state of Kerala challenging the validity of Kerala Irrigation and Water Conservation (Amendments) Act 2006, unanimously passed by Kerala Assembly on March 15 this year.
Tamil Nadu has challenged the Constititional validity of the Act on the ground that a State Legislative Assembly cannot pass or enact the law affecting the interests of other states. The plaintiff's claim has also contended that the impugned act has been brought just to create hurdles in the way of increasing the height of Mullaiperiyar dam from 136 ft to 142 ft as per the Supreme Court order of February 27.
The impugned act is in direct conflict with the Supreme Court order which amounts to wilful and deliberate disobedience of the Apex court's direction.
