Advani urges for early and considered decision on Chawla

On Board the vehicle of Bharat Suraksha Yatra, Apr 9 (UNI) Leader of Opposition in Lok Sabha and senior BJP leader L K Advani today urged President A P J Abdul Kalam to take an 'early, considered and correct decision' on the complaint filed by 200 MPs against Election Comissioner Navin Chawla.

Talking to UNI, Mr Advani said Article 324 (5) of the Constitution relating to removal of Election Commissioner (EC) was very clear and the President has to take the advice of the Chief Election Commissioner (CEC) on any complaint made against the Election Commissioner. Parliament was the decision making body in the event of removal of the CEC and the constitution provisions gave no space whatsoever either to the government or to the Attorney General who had no locus standi on this issue, he added.

''The President is to act on the recommendation of the CEC,'' Mr Advani said.

An NDA delegation consisting of convenor George Fernandes and leader of opposition in the Rajya Sabha Jaswant Singh had told the President that the MPs as well as the President were bound by an oath to preserve and protect the constitution.

Mr Advani noted that the President should take into consideration the advice of the Prime Minister and the Union Cabinet to dissolve the Bihar Assembly, which had resulted in the Supreme Court not just admonishing the then state Governor Buta Singh but also the Union Cabinet. ''The PM had obtained the President's consent for the Bihar Assembly dissolution when he was on a visit abroad,'' he alleged.

''I would like to urge the President to ensure that a very correct decision is taken very soon,'' he stressed.
