ACB directed to file affidavit in Daya Nayak case
Mumbai, Apr 4: Bombay High Court today directed the anti-corruption bureau (ACB) to file an affidavit till April 12 in response to a bail plea moved by Rajendra Padte, a co-accused in suspended encounter specialist Daya Nayak's disproportionate asset case.
Justice V M Kannade's directive came even as defence counsel Shyam Marwari sought bail on parity basis as co-accused in the case, P Manivelan was granted bail by the High Court on technical grounds after the prosecution had failed to file the charge sheet in the stipulated period of 60 days.
Assistant government pleader Sangeta Sindhe, while opposing the plea, argued that accused cannot claim parity as he has only completed 35 days in custody where procsecution was supposed to file a chargesheet within this period after the arrest of an accused booked in an anti-corruption case.
