Governor wants reconsideration of offices of profit bill

Dehradun, Apr 3 (UNI) Uttaranchal Governor Sudarshan Agarwal today returned for reconsideration a bill seeking exemption of certain posts from the category of 'offices of profit' and allowing their holders to remain as members of the Assembly.

The written communication from the Governor stated that a certain entry made in the Uttaranchal Legislature (Prevention of Disqualification) Act, 1971, did not specifically identify the office to meet the constitutional requirement.

It further stated that the entry did not appear to be in conformity with the provision of the Constitution which said that only a post declared by the state legislature as ''not an office of profit'' could protect the holder from disqualification from the house under Article 191.

The Governor has also requested the assembly, which sent the bill for his consent after passing it on March 27, to specifically identify other actual offices to meet the constitutional requirement.
