HC quashes pvt complaint against Kunjalikutty

Kochi, Mar 1 (UNI) The Kerala High Court today quashed the private complaint pending before the Judicial First class Magistrate Court-IV, Kozhikode, seeking to take cognizance against former minister P K Kunjalikutty, for the offence of rape, on the basis of the disclosure of Regina, a witness in the ice cream parlour case.

Mr P J Sebastian, a social worker, had filed the complaint based on the information given through the media on October 28, 2004 that Mr P K Kunjalikutty sexually exploited her on various occasions.

Though the complainant himself moved a petition before the magistrate to withdraw the complaint, the court was not inclined to allow the same. The withdrawal petition was filed subsequent to the judgement of the division bench to the effect that further investigation was not warranted in the ice cream parlour sex case.

Mr Justice K Thankappan, while allowing the petitions of the state government and 7th accused O Rajagopal, was of the view that the continuance of proceedings in the complaint was an abuse of the process of court and the complaint was liable to be quashed.
