Goel said that if Kejriwal failed to apologise to him, he would go ahaead and file a criminal case against him. Goel in the legal notice said that Kejriwal had made defamatory statements delibrately and with malafide allegations of corruption against him through pre-recorded telephone messages and radio broadcasts.

However Kejriwal refused to apologise to Goel saying that they was no question of tendering an apology for his public statements.

The alleged phone messages that Goel has pointed out has Kejriwal urging people to be mindful in defeating Congress and electing BJP. A portion of the message says, "What do you think if Mr Vijay Goel becomes the CM of Delhi, then would he run the government with honesty? He would, within four days , leave Shiela Dikshit behind in corruption."
