SC Responds To BJP’s Nishikant Dubey Amid Bengal Federal Rule Plea Debate

The Supreme Court has addressed claims of judicial overreach in response to divisive remarks made by some BJP leaders about its most recent historic decision. The court is already being accused of intruding on the executive branch, said Justice BR Gavai, who will take over as Chief Justice next month. Advocate Vishnu Shankar Jain made this remark following the presentation of a pending case related to the violence in West Bengal, requesting that the Center send paramilitary forces to bring about peace.

In the appeal, Jain asks for the creation of a panel consisting of three retired judges to look into the violence that occurred in West Bengal after the 2022 election. In addition, he requested a report on the Hindus who were displaced after the riots in Murshidabad, North Bengal.

Justice Gavai's statement highlights the Supreme Court's awareness of continuous criticism of the judiciary's recent rulings, especially from members of the ruling party. In the Tamil Nadu case, the Supreme Court declared that the Governor's decision to withhold bills was "arbitrary." This ruling has been one of the most talked-about rulings. The ruling emphasized the court's sole authority to decide whether a bill is constitutional and recommended that the President bring such cases to the Supreme Court.

Nishikant Dubey, a BJP MP, criticized the Supreme Court of going too far after this ruling. Dubey expressed disapproval of the court's ruling, saying that if the Supreme Court is to make all the judgments, Parliament had to be shut down. He suggested that such measures were unheard of and improper, and he questioned how the Supreme Court could establish a timetable for the President and Governors to clear bills.

Additional statements made by BJP officials, such as Vice-President Jagdeep Dhankhar, also criticized the court and questioned the legitimacy of its authority under Article 142. Dhankhar referred to Article 142 as a "nuclear missile" that the judiciary may use to sway democratic forces at any time.

In the face of criticism, BJP President JP Nadda disassociated the party from the divisive remarks, claiming they were individual viewpoints and did not represent the party's official position. Nadda reiterated the BJP's respect for the judiciary and made it clear that it does not endorse such statements.

The influence of the ongoing debate on the charges of judicial overreach on the relationship between the Indian judiciary and the executive branch is still unknown.
