Why J&K Polls May Extend Beyond SC's Deadline? CEC Rajiv Kumar Explains

Chief Election Commissioner Rajiv Kumar addressed the delay in scheduling assembly elections in Jammu and Kashmir, which extends beyond the Supreme Court's September 30 deadline. He cited the Amarnath Yatra, ending on August 19, and adverse weather conditions as reasons for the delay. "We couldn't start exactly on August 19 due to these factors," Kumar explained during a press conference.

Supreme Court's Directive and Article 370

Last December, the Supreme Court upheld the abrogation of Article 370 as constitutionally valid. The apex court also directed the Election Commission to conduct assembly elections in Jammu and Kashmir by September 30. Chief Justice of India DY Chandrachud stated that Article 370 was a temporary provision, and the president had the authority to revoke it.

The Narendra Modi government removed Jammu and Kashmir's special status by abrogating Article 370 on August 5, 2019. This move bifurcated the state into two Union territories: Jammu and Kashmir, and Ladakh.

Election Schedule Announced

Elections for the 90 assembly constituencies in Jammu and Kashmir will occur in three phases: September 18, September 25, and October 1. The vote counting is scheduled for October 4. Chief Election Commissioner Rajiv Kumar emphasized that despite delays, they are committed to completing the process within a reasonable timeframe.

Kumar also mentioned that amendments to the J&K Reorganisation Act regarding reservations were made in December 2023. "It is not about sticking to exact dates but adhering to the spirit of conducting fair elections," he added.

During a press conference with Election Commissioner Gyanesh Kumar, Rajiv Kumar reiterated their commitment to holding timely elections despite challenges. He assured that all necessary steps are being taken to ensure a smooth electoral process.

The Lok Sabha elections concluded on June 4-6, adding another layer of complexity to scheduling assembly polls immediately after. "We are not giving even half a day when one could have started," Kumar noted, highlighting logistical constraints.

The Congress party has expressed concerns over Jammu and Kashmir still waiting for full statehood following these developments. They continue to urge for timely restoration of statehood alongside fair elections.

The Election Commission remains focused on ensuring that all electoral processes adhere to constitutional mandates while considering practical challenges like weather and ongoing events such as the Amarnath Yatra.

Despite delays, efforts are underway to ensure that elections are conducted transparently and efficiently within the stipulated period set by legal directives.
