What Is the Kamduni Case? Its Relevance Amid Kolkata Hospital Doctor’s Rape And Murder

On August 9, a trainee doctor was raped and murdered at the RG Kar Medical College and Hospital in Kolkata. The incident has sparked widespread protests among resident doctors and medical students across the city's government hospitals. They staged demonstrations on August 16, demanding justice for the victim.

The June 2013 gang rape and murder of a student in Kamduni, West Bengal, has resurfaced amid these protests. The Kamduni case was investigated by the Criminal Investigation Department (CID) of West Bengal. Vineet Goyal, who is now Kolkata's Commissioner of Police, was then the special inspector general (IG) in the CID.

Kamduni Case: A Grim Reminder

On June 7, 2013, a second-year undergraduate student aged 20 was returning home to Kamduni near Kolkata. She was abducted while alone and dragged to an isolated farm. Her mutilated body was discovered the next morning with her private parts severely damaged.

Facing public outrage, the state's Trinamool Congress (TMC) government ordered a CID probe into the Kamduni case. Vineet Goyal directed inspector Anandamoy Chatterjee to lead the investigation. Nine men were arrested; however, Rafiqul Islam and Noor Ali were acquitted due to insufficient evidence, while Gopal Naskar died during the trial.

Legal Proceedings and Sentences

In January 2016, the trial court sentenced Saiful Ali, Ansar Ali, and Amin Ali to death. Sheikh Imanul Islam, Aminur Islam, and Bhola Naskar received ten years in jail. The presiding judge termed it as one of the 'rarest of rare' crimes.

In October 2023, the Calcutta High Court commuted Saiful and Ansar's death sentences to life imprisonment while acquitting Amin Ali. The three convicts who received life imprisonment were released after completing their jail term. The HC's division bench noted that the trial court had erred in awarding the death penalty as the state failed to prove a conspiracy beyond reasonable doubt.

The West Bengal government has challenged this order in the Supreme Court. This legal battle continues as public sentiment remains high over both cases.

The recent murder at RG Kar Medical College has reignited memories of past atrocities like Kamduni. Both incidents highlight ongoing issues with safety and justice for women in West Bengal.
