Waqf Amendment Bill Seeks Inclusive Representation and Act Renaming

A bill proposing significant amendments to the Waqf boards' law aims to introduce notable changes, including ensuring representation for Muslim women and non-Muslims. The Waqf Amendment Bill, which is set to be introduced in the Lok Sabha, also seeks to rename the Waqf Act, 1995, as the Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995.

The bill's statement of objects and reasons highlights its goal to omit Section 40 of the current law that grants the Board the power to decide if a property is Waqf property. It aims to create a broad-based composition for the Central Waqf Council and State Waqf Boards, ensuring representation for Muslim women and non-Muslims. Additionally, it proposes establishing a separate Board of Auqaf for the Boharas and Aghakhanis.

Defining Waqf Property

One of the bill's objectives is to clearly define Waqf as property dedicated by any person practising Islam for at least five years and owning such property. It also aims to streamline the registration process of Waqfs through a central portal and database. A detailed procedure for mutation as per revenue laws is established, with due notice given to all concerned before recording any property as a Waqf property.

Historical Context

The Wakf Act, 1995, was initially brought in to regulate Auqaf assets donated and notified as Waqf by a wakif, the person who dedicates a property for any purpose recognised by Muslim law as religious or charitable. The Act was last amended in 2013.

Inclusivity Among Muslim Communities

The draft law provides for the representation of Shias, Sunnis, Bohras, Agakhanis, and other backward classes among Muslim communities. This inclusivity aims to ensure that diverse groups within the Muslim community have a voice in the management of Waqf properties.

The proposed amendments reflect an effort to modernise and make the governance of Waqf properties more inclusive and efficient. By addressing representation issues and streamlining administrative processes, the bill seeks to enhance transparency and accountability within Waqf boards.
