Rahul Gandhi Hails Supreme Court's Take on BJP's Bulldozer Policy
The Supreme Court's recent remarks on the demolition of houses of accused individuals have sparked significant reactions. Congress leader Rahul Gandhi criticised the BJP, stating that its unconstitutional actions have now been exposed. He welcomed the court's observation, which questioned the legality of demolishing homes simply because someone is accused of a crime.

Supreme Court's Stance on Demolitions
The apex court has decided to establish guidelines to address this issue nationwide. A bench comprising Justices B R Gavai and K V Viswanathan highlighted that demolishing someone's house solely based on accusations is unjust. They emphasised that even if a person is convicted, due legal procedures must be followed before any demolition.
Rahul Gandhi expressed his views in a post on X, where he stated, "The anti-constitutional face of BJP, which has crushed humanity and justice under the bulldozer, has now been exposed in front of the country." He further added that the bulldozer symbolises unchecked power and has repeatedly violated civil rights with impunity.
Impact on Marginalised Communities
Gandhi pointed out that it is often the homes of marginalised communities and the poor that are targeted. He argued that these actions are carried out under the guise of instant justice but are actually meant to instil fear. He urged the Supreme Court to issue clear guidelines to protect citizens from what he termed as an anti-democracy campaign by BJP governments.
Former Rajasthan Chief Minister Ashok Gehlot also welcomed the Supreme Court's observation. In his post on X, he stated, "Principles like instant justice are not acceptable in a civilised and law-abiding society and are completely against the basic spirit of the Constitution." Gehlot reiterated his earlier stance against this practice, aligning with the court's current observations.
Solicitor General Tushar Mehta, representing Uttar Pradesh, referred to an affidavit filed by the state. The affidavit clarified that mere allegations cannot justify the demolition of immovable property. Mehta stressed that demolitions should only occur for violations as per municipal laws or development authority regulations.
Need for Clear Guidelines
The Supreme Court bench underscored the necessity of formulating guidelines to prevent misuse by individuals or authorities. They noted that unauthorised constructions or encroachments on public roads would not be protected under these guidelines. This move aims to ensure fairness and adherence to legal procedures.
Gandhi concluded his remarks by asserting that India's governance should be based on Dr B R Ambedkar's Constitution rather than arbitrary exercises of power. He expressed hope that the Supreme Court's guidelines would safeguard citizens' rights against unjust demolitions.
The court's decision to lay down enforceable guidelines marks a significant step towards ensuring justice and protecting civil rights. It reflects a commitment to upholding constitutional principles and preventing misuse of power by authorities.
