Punishment Replaced By Justice In New Criminal Laws: Amit Shah

Union Home Minister Amit Shah announced today that three new criminal laws have come into force, representing a shift from traditional punitive measures to a justice-centric approach.

This move, described as establishing a 'swadeshi' legal system 77 years after Independence, marks a significant transformation in India's legal framework.

Survivors of crimes involving violence against women can now have their statements recorded at home, aimed at protecting them from social stigma.

"There was no provision in law for mob lynching case. It has now been defined. This was a longstanding demand. Also, we have completely removed the section of treason and brought a new section for anti-national activities. Earlier, it was a crime to make a statement against the government. Now, a law will provide for action against attempts to harm India's unity and sovereignty," Shah said, sharing the highlights of the new criminal codes.

An online facility for filing FIRs has been also been introduced, making it easier for victims to report crimes.

Videography during search and seizure operations is now mandatory, aimed at preventing wrongful accusations. The e-statement of survivors of rape or sexual harassment is now legally valid.

Police must maintain both a physical register and an e-register at every station, listing individuals in police custody. This aims to reduce the need for habeas corpus pleas.

All searches and raids will be videographed to ensure transparency, reported NDTV.

"Earlier, police picked someone up and his family members had to go to court. Now we have made it compulsory to maintain a register and e-register at every police station that will list which criminal is in police custody. So a habeus corpus plea in court won't be needed," Shah said.

Addressing criticisms from Opposition leaders, Shah stated that the Ministry had sought input from MPs, Chief Ministers, judges from the Supreme Court and high courts, and bureaucrats.

He dismissed allegations that the new laws were not properly debated and were forcibly passed in Parliament, asserting that extensive consultations were conducted before their implementation.
