Nagaland Assembly Stands Against Proposed Uniform Civil Code and Forest Conservation Amendment Act

The Nagaland assembly has opposed the proposed Uniform Civil Code (UCC) and implementation of the Forest Conservation Amendment Act. The discussion included all parties such as NDPP, BJP, NCP etc., with a focus on protection under Article 371A for Nagas.

The Nagaland assembly on Monday registered its opposition to the proposed Uniform Civil Code (UCC) and the implementation of the Forest Conservation Amendment Act. The assembly called for protection under the 16-Point Agreement and Article 371A, which provides special provisions for Nagaland, a state in North-East India. This move was discussed by all parties present including the Nationalist Democratic Progressive Party (NDPP), Bharatiya Janata Party (BJP), Nationalist Congress Party (NCP), Meghalaya NPP, LJP Ram Vilas, Naga People’s Front (NPF), RPI Athawale, JDU and Independents during the first day of the monsoon session.

Special Protection Under Article 371A

Nagaland assembly opposes UCC

NPF MLA Kuzholuzo Nienu emphasized that Nagas have special protection under Article 371A; hence there was an urgent need to discuss both UCC and Forest Conservation Amendment Act. He further clarified that according to Article 371A no act of Parliament shall apply to Nagaland concerning religious or social practices of Nagas, their customary laws and procedure. It also covers administration of civil and criminal justice involving decisions as per Naga customary laws as well as ownership and transfer of land along with its resources unless decided by state assembly.

A Resolution Against UCC And Forest Act

Nienu proposed that a resolution rejecting both UCC and forest Act should be passed by the House. His proposal highlights local concerns about potential infringement upon traditional rights guaranteed under existing legal provisions such as Article 371A. The apprehension is primarily related to how these new legislations might affect indigenous communities' unique cultural practices and their relationship with natural resources.

Solidarity Among Political Parties

In response to these concerns raised in Assembly, Temjen Imna Along, Nagaland BJP president and cabinet minister, assured that they would stand in solidarity with the resolution adopted by the assembly on both issues. This assurance from a key political figure indicates a broad consensus among different political parties in Nagaland over these two contentious issues.
