CJI D Y Chandrachud Discusses Compatibility of Traditional Values and Modern Democratic Principles

Chief Justice of India D Y Chandrachud addressed the third convocation at Jigme Singye Wangchuck School of Law in Bhutan. He highlighted a common misconception that traditional values in India and Bhutan clash with modern democratic ideals like liberty and equality. He argued that these values can coexist and complement each other.

He emphasised that both nations have communities that use traditional methods for resolving disputes and governance. These methods should not be dismissed as outdated but should be integrated with modern constitutional principles. "There is often a misconceived perception that the traditional values of our communities are antithetical to modern democratic ideas such as liberty, equality and dissent," he stated.

Traditional Values and Modern Governance

CJI Chandrachud pointed out that India's Constitution includes provisions for village panchayats and gram sabhas. These institutions blend traditional processes with modern political thought. This integration explains the importance of public debate in India's democracy and secular politics, he noted.

Similarly, Bhutan's Constitution focuses on environmental stewardship, declaring every citizen a trustee of natural resources. It is a fundamental duty for citizens to protect the environment for future generations. The government is committed to preserving biodiversity, preventing pollution, and promoting sustainable development.

Cultural Wealth and Legal Education

The Chief Justice praised Bhutan's rich cultural and intellectual heritage, noting its significance for both local and global legal communities. He admired the institution's success in combining modern legal education with cultural values. "I am inspired by the blend of modern, technologically advanced legal education with deep-rooted cultural and ethical values," he remarked.

He also mentioned the focus on clinical education, which imparts technical skills while teaching students to appreciate traditional dispute resolution methods. This approach is seen as an innovative experiment in legal education.

Global Influences and Cultural Identity

CJI Chandrachud discussed how countries like India and Bhutan face diverse influences, especially from Western cultures. He stressed the need to challenge the assumption that Western values are universally applicable. "The conventional Western definition of human rights... fails to account for the diverse perspectives and cultural nuances," he observed.

He urged for a careful adoption of global norms that enhance rather than replace existing values. This approach allows countries to blend tradition with modernity effectively, creating a unique path towards progress.

Reflections on Tenure

As his tenure nears its end on November 10, CJI Chandrachud reflected on his service as Chief Justice of India. He shared his thoughts about his achievements and legacy, pondering questions about his impact and how history will judge his tenure.

"The answers to most of these questions lie beyond my control," he admitted. Despite uncertainties, he finds solace in knowing he served with dedication. "Once you have this sense of faith in your intentions and abilities... you begin to value the process," he concluded.
