Background of the Case

Earlier, the High Court had barred students from nursing colleges found to be operating without essential facilities from taking the examinations. This decision left a large number of students in limbo, prompting some to file applications seeking permission to appear for the exams.

Court's Decision

The division bench of Justices Sanjay Dwivedi and AK Paliwal considered the applications and granted relief to the students. The court order states that students from unsuited colleges will be allowed to participate in the examination, but this opportunity is a one-time measure. If they fail to clear the exam, they will not be entitled to any further benefits.

Students' Contribution During COVID-19

The students of unsuited nursing colleges highlighted their valuable contributions during the COVID-19 pandemic. They provided their services at government health centres when doctors and permanent staff were hesitant to work due to safety concerns. The court acknowledged their dedication and selfless service during challenging times.

Modification of Previous Order

The students sought a modification of the earlier order dated February 8, 2024, which restricted students from unsuited colleges from participating in the examination. The court agreed to modify the order, allowing these students to take part in the upcoming exams.

Admission-Related Issues

Regarding admissions to nursing colleges, the court permitted suited colleges to commence student enrolment for the 2022-23 academic session. However, the decision for the 2023-24 session will depend on the state government's decision based on a proposal submitted by the MPMSU MP Medical Science University.
