Petitioner's Claims

The petitioner, Sanjay Kumar Nidshad, had filed the petition alleging that the statue was not in accordance with the description provided in the Ramcharitmanas of Goswami Tulsidas. He further claimed that the statue depicted Lord Ram and King Nishad Raj in a hugging position, which he and members of his community found objectionable and a violation of their constitutional right to worship.

Court's Observations

The court, comprising Acting Chief Justice Manoj Kumar Gupta and Justice Donadi Ramesh, observed that the issue raised by the petitioner could not be decided in the present proceedings and that it fell within the domain of the executive. The court also expressed its dissatisfaction with the petitioner's claim that any constitutional right had been violated.
