Jammu and Kashmir High Court Issues Notice to Election Commission Over Chenani Assembly Election Petition

The Jammu and Kashmir High Court has taken action on a petition filed by Harsh Dev Singh, a candidate from the National Panthers Party India. Singh is challenging the validity of the 2024 assembly election results in the Chenani segment. He was defeated by Balwant Singh Mankotia of the BJP, who won by 15,611 votes. Mankotia secured 47,990 votes in total.

High Court Notices Issued on Chenani Election

Justice Rajneesh Oswal has instructed that notices be sent to various parties, including the Election Commission of India and the Chief Electoral Officer of Jammu and Kashmir. These notices are expected to be returned within four to five weeks. Singh's lawyer, Aseem Sawhney, confirmed this development after the court session.

Allegations of Election Misconduct

The court has also directed notices to the Home Department and the returning officer for the Chenani assembly constituency. The elected candidate from this constituency is among those notified. Sawhney's legal team argued that the election process was marred by significant corrupt practices and undue influence.

The lawyers further alleged that religion was used to sway voters and that false information about Singh was spread during the campaign. They claimed that government officials, including the returning officer, exhibited bias in managing the election process.

Singh's petition seeks to have the election results declared null and void due to these alleged irregularities. The court's decision to issue notices indicates a willingness to examine these serious allegations thoroughly.

The outcome of this legal challenge could have implications for future elections in Jammu and Kashmir. It highlights ongoing concerns about electoral integrity and fairness in the region.
