Hindustan Will Run As Per Majority's Wishes: Allahabad High Court Judges Statement Sparks Debate

Justice Shekhar Kumar Yadav, a judge at the Allahabad High Court, recently sparked controversy with his comments on the Uniform Civil Code (UCC) during a Vishwa Hindu Parishad event in Prayagraj. He stated that "Hindustan would run as per the wishes of the majority people" living in the country. Justice Dinesh Pathak, another sitting High Court judge, was also present at the event.

The UCC aims to create uniform personal laws for all citizens, irrespective of religion, gender, or caste. It covers areas like marriage, divorce, adoption, inheritance, and succession. Justice Yadav criticised practices such as having multiple wives, triple talaq, and halala without directly naming any community. He emphasised that these practices are "unacceptable" and cannot be justified by personal law.

Controversial Remarks and Past Statements

Justice Yadav's remarks are not new to controversy. In September 2021, he made headlines by claiming that "scientists believe that the cow is the only animal that exhales oxygen." He urged Parliament to declare the cow as India's national animal and make cow protection a "Fundamental Right of Hindus." These statements were made while denying bail to an individual accused under the UP Cow Slaughter Act.

He also highlighted social evils within Hinduism like child marriage and Sati but praised reformers like Ram Mohan Roy for their efforts to eradicate these practices. Justice Yadav pointed out that Hindus do not expect other communities to adopt their culture but expect respect for Indian culture and its revered figures.

Hope for Nationwide Uniform Civil Code

Expressing hope for a nationwide UCC, Justice Yadav compared it to the construction of the Ram Temple in Ayodhya. He mentioned that although it took time, he believes "the day is not far when it will be clear that if there is one country, there should be one law." He warned against those trying to deceive or pursue their own agendas.

Justice Yadav further commented on cultural differences regarding compassion and tolerance. He noted that Indian teachings discourage harming even small creatures like ants. In contrast, he claimed other cultures expose children early to animal slaughter, questioning how they can learn compassion.

In 2021, Justice Yadav suggested postponing Uttar Pradesh Assembly elections due to Covid-19 risks and recommended banning election rallies. His remarks often stir debate due to their controversial nature and strong opinions on various issues.

The judge clarified that UCC isn't solely advocated by organisations like VHP or RSS but is also discussed by India's top court. He stressed that rights claimed under personal laws must align with broader societal welfare and happiness.

The judge's comments have reignited discussions around UCC implementation in India. The debate continues over balancing personal freedoms with uniformity in laws across diverse communities in India.
