Dr Vandana Bagga Files Complaint Over Suspension, Claims Violation of Constitutional Norms

Dr Vandana Bagga, the suspended Director General of Health Services, has filed a complaint against her suspension. She claims it breaches the Election Commission's Model Code of Conduct and constitutional norms. Dr Bagga argues that her suspension is politically motivated to favour a specific party in the upcoming Delhi Assembly elections.

Dr Bagga Complains About Suspension Violation

According to Dr Bagga, the suspension order was issued on January 7 under Lieutenant Governor VK Saxena's authority. However, she contends that this action is illegal and arbitrary, as it bypasses the elected government's authority over health matters, which are a state subject under the Constitution.

Allegations of Confidentiality Breach

Dr Bagga has raised concerns about confidentiality breaches, claiming that the suspension order was leaked on WhatsApp. She states that this action violates confidentiality protocols. Furthermore, she highlights that the order lacks any advisory or consent from Delhi's Health Minister or Council of Ministers.

In her complaint, Dr Bagga argues that her suspension contravenes Rule 101 of the Central Civil Services Classification, Control, and Appeal Rules, 1965. She emphasises that there are no disciplinary proceedings against her nor any criminal accusations.

Violation of Natural Justice Principles

Dr Bagga asserts that she was not given an opportunity to present her case before the suspension was issued. She believes this violates natural justice principles. She describes the suspension as illegal, void ab initio, and arbitrary.

The Vigilance Department is accused by Dr Bagga of leaking the confidential order for ulterior motives. She urges the government to revoke the suspension immediately and warns of pursuing legal remedies if her concerns are not addressed.

The complaint highlights Dr Bagga's belief that the suspension order is politically driven and lacks legal basis. Her demand for revocation underscores her commitment to challenging what she perceives as an unjust action.
