BJP MP Advocates for Reforms in Muslim Personal Laws at India Today Conclave

During a discussion at the India Today Conclave, BJP MP Sushil Kumar Modi emphasized on the need for reforms in Muslim personal laws to ensure gender neutrality. He criticized practices like polygamy and triple talaq, arguing that there is a pressing need for changes in these existing regulations.

On Wednesday, October 4th, BJP MP Sushil Kumar Modi emphasized the necessity for reforms in Muslim personal laws at the India Today Conclave held in Mumbai. The discussion revolved around the topic of Uniform Civil Code (UCC): Majoritarian Agenda or Much-needed Reform? During his speech, he put forth a strong argument that it is high time to bring about gender neutrality in these laws.

Uniform Civil Code

Modi, who has previously served as Deputy Chief Minister of Bihar, pointed out practices like polygamy and triple talaq as examples where reforms are needed. He questioned the rationale behind certain rules which seem to be unfair towards women. In particular, he took issue with a law that requires a divorced woman wanting to remarry her first husband to marry another man and get divorced from him before she can fulfill her wish.

The Counter Argument

All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi was also part of this discussion along with women's right activist and lawyer Flavia Agnes. Owaisi defended Muslim personal laws by stating that they do provide certain rights and protections for women. For instance, if a Muslim man takes a second wife, she is entitled to maintenance and a separate house to live in.

Owaisi further argued that such provisions make sure she gets maintenance rights and is legally recognized as a wife unlike in Hinduism where if a man marries again without divorcing his first wife; the second woman does not receive any legal recognition or protection under law.

A Call for Reform

Despite these counter arguments presented by Owaisi, Modi insisted on the need for bringing about changes within the existing framework of Muslim personal laws. His main contention was centered around ensuring gender neutrality so as to protect the rights of women and provide them with equal status in society.

Modi's call for reforms is indeed a significant one. It not only highlights the need to question and revaluate certain traditional practices but also underlines the importance of ensuring gender equality within all legal frameworks. Such debates are crucial as they encourage dialogue and introspection about societal norms, laws, and practices that have been followed for centuries without much questioning.

Conclusion

In conclusion, while personal laws aim to preserve cultural diversity and religious freedom, it is essential to ensure that they do not infringe upon basic human rights or perpetuate gender inequality. The discussion at the India Today Conclave has drawn attention to this important issue once again. It remains to be seen how these debates will shape future reforms in personal laws across different communities in India.
